Terms and conditions
These terms apply to all quotes and agreements with Stavhaus. We have written them in plain language so you know where you stand in advance: how the quote works, how you pay, how we handle additional work, what happens if you cancel and what warranty you get.
Article 1. Who we are and when these terms apply
- Stavhaus is a trade name of Dromenbouw, Locatellistraat 4 A, 5654 JE Eindhoven, the Netherlands. Chamber of Commerce (KVK) 95836861, VAT number NL005176149B49. You can reach us at [email protected] and +31 6 30 40 58 88.
- These terms apply to all our quotes, agreements and work: timber garages, garden studios, offices and outbuildings, extensions and sheds, the demolition of an existing building if you ask for it, and all other work we carry out for you, including additional work.
- If you are a consumer, your statutory rights always come first. Nothing in these terms limits those rights.
Article 2. Quote and price
- We prepare a quote after a visit on site, based on what we saw there and on what you told and sent us, such as photos and measurements. The quote describes the building, its dimensions, the materials and the price. All prices for consumers include VAT. On the website we also give the amount without VAT next to the price.
- A quote is valid for 30 days unless it states a different period. After that, material prices may have changed and we will gladly prepare a new quote.
- The price in the quote is a fixed price for the described work. It only changes through additional or reduced work we agree together (article 5), through unforeseen circumstances (article 5.3) or through a statutory change in VAT.
- Work not listed in the quote is not included in the price. Examples: the floor, lighting and electrics, groundworks beyond the foundation, removing soil, demolishing an existing building, removing asbestos and permit fees.
- Obvious mistakes or typing errors in a quote, such as an incorrectly copied price, do not bind us. We report this as soon as possible and you may then withdraw from the order free of charge.
Article 3. Agreement, cooling-off period and cancellation
- The agreement is concluded as soon as you accept the quote in writing, for example by e-mail, WhatsApp or by signing the quote.
- If, as a consumer, you conclude the agreement at a distance or at your home, you have a 14-day cooling-off period in which you may withdraw from the agreement without giving reasons. If you want us to start or order materials within those 14 days, we ask you for that explicitly. If you still withdraw afterwards, you pay for the work and materials delivered up to that moment.
- If you cancel after the cooling-off period, the statutory rules for contracting work apply: you pay the agreed price, less the costs we save as a result of the cancellation. In practice these are the materials we have already bought or ordered for you, the work already done and the costs already incurred. Together with you we record how much work has been done and send you an itemised final invoice. Anything you have overpaid is refunded within 14 days.
- We may terminate the agreement if you fail to meet your obligations, for example if a payment remains outstanding even after a reminder, or if we cannot work because of something on your side. Paragraph 3.3 then applies as well.
Article 4. Payment
- You pay in three instalments: 40% of the price when you place the order, 40% when the timber frame and the roof are up, and 20% on completion. You pay each invoice within 7 days of the invoice date by bank transfer.
- Materials made or ordered especially for you, such as window frames, doors and the sectional door, are ordered once the first instalment has been paid.
- The last invoice includes the additional and reduced work set off.
- If you do not pay on time, we first send a free reminder with a 14-day term. If payment is still not made after that, we may suspend the work until payment is received and charge the statutory interest and the statutory collection costs.
Article 5. Additional work, reduced work and unforeseen circumstances
- We only carry out work that is not in the quote after we have told you the price and you have agreed to it, also by e-mail or WhatsApp. We are not obliged to take on additional work.
- If you drop work from the quote (reduced work), we set that off in the final invoice. Costs we have already incurred for it, such as ordered materials, remain at your expense.
- If during the work we encounter something nobody could have foreseen, such as ground that does not bear the load, rubble or an old foundation in the ground, cables or pipes, or asbestos, we stop the work at that point, show it to you and discuss the solution and the costs together before continuing.
- We do not remove asbestos ourselves, for example in the corrugated sheets of an old shed or garage. If we suspect asbestos, we stop the work at that spot; the survey and removal by a certified company is arranged by you, or by us in consultation at your expense.
Article 6. Planning and execution
- The start date and the building time in the quote, usually 2 to 4 weeks on site, are a careful estimate, not a firm deadline. Material lead times, weather, unforeseen circumstances and additional work can shift the schedule. We tell you as soon as possible and plan the work as continuously as possible.
- We carry out the work with our own team. If we bring in a specialist for a part of it, we remain your point of contact and responsible for the result.
- We work tidily, keep the site orderly and remove our construction waste, unless the quote states otherwise.
Article 7. What we need from you
- You make sure we can start on the agreed day: the site can be reached for the delivery of materials and is clear of belongings and plants, and water, electricity and a toilet are available.
- We check with you whether your building may go up without a permit. You are responsible for any building permit and for the consent of third parties, such as your neighbours, the owners' association or the landlord; the municipality decides. If, in consultation, we apply for the permit for you, the fees remain at your expense.
- You show us in advance where cables, pipes, drains and drainage run in the ground, as far as you know them. Damage to cables or pipes that were not pointed out and could not reasonably be expected is at your expense.
- You move or cover belongings on or next to the site. We are not liable for damage to items left behind, except in the event of intent or gross negligence on our part.
Article 8. Completion, service period and warranty
- When the work is finished, we go through it together with you. Points you see at that moment we note down and repair within a reasonable period. The work is then completed; small points on the snag list are no reason to postpone completion or payment.
- After completion there is a service period of 2 months. Defects that come to light in that period and are attributable to our work we repair free of charge and as soon as possible.
- After the service period you remain protected. Defects that were not discovered at completion and come to light later we repair if they are attributable to our work; this is set out in Dutch law (article 7:758(4) of the Civil Code). The work must be sound and in accordance with what was agreed. Materials such as the roofing, the window frames and the sectional door additionally carry the manufacturer's warranty.
- Not covered by the warranty are normal wear, the natural greying of timber and the small cracks and movement that belong to wood, damage from incorrect use, lack of maintenance, flooding or subsidence of the ground beyond the foundation, and work that has been altered or repaired by others.
- If you notice a defect, report it as soon as possible, preferably with a photo, via [email protected] or WhatsApp. Then we can look at it and resolve it before further damage occurs.
Article 9. Liability
- If we are liable for damage, our liability is limited to the amount our business liability insurance pays out in that case, and if it does not pay out, to the price of the order to which the damage relates.
- We are not liable for consequential loss, such as lost income, nor for damage resulting from incorrect or incomplete information on your part or from cables and pipes that were not pointed out to us.
- These limitations do not apply in the event of intent or deliberate recklessness on our part, in the event of damage resulting from death or injury, and in other cases where the law does not permit a limitation.
Article 10. Retention of title and force majeure
- Delivered materials that have not yet been incorporated remain our property until you have paid everything you owe us for the order.
- If we cannot perform the agreement, or not on time, due to circumstances beyond our control, such as extreme weather, illness, a supply problem at a supplier or government measures, the work is postponed for as long as that circumstance lasts. We inform you as soon as possible. If the force majeure lasts longer than 3 months, both parties may terminate the agreement for the part that has not yet been performed, without compensation.
Article 11. Complaints, applicable law and disputes
- If you have a complaint, e-mail [email protected]. You will receive a response within 5 working days and we will look for a solution together with you.
- Dutch law applies to all agreements. If we cannot resolve a matter together, the dispute may be submitted to the competent court. If you are a consumer, you may also choose the court of your own place of residence.
Article 12. Final provisions
- How we handle your personal data is explained in our privacy statement.
- If a provision of these terms is invalid, the remaining provisions remain in force and we replace the invalid provision with a valid one that comes as close to it as possible.
- These terms are available in Dutch and English. In the event of differences between the versions, the Dutch text prevails.
